Terms of Service

Last updated: November 4, 2026

Acceptance of These Terms

These Terms of Service ("Terms") govern your use of the Emergency Water Damage Nyc website and phone line. By visiting the site or calling our number, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site or call the line. You can always contact a contractor directly instead.

In these Terms, "Emergency Water Damage Nyc," "we," "us" and "our" mean the referral service. "You" means the person using the site or calling the line. "Contractor" means any independent business we connect your call to.

What Our Service Is

Emergency Water Damage Nyc is a free referral and call-routing service. When you call, we ask about your problem and your location, and we connect your call to an independent local contractor who may be available to help with water damage or another home service need. That is the whole service.

We are not a contractor. We do not perform, supervise, direct or control any work. We do not send anyone to your property, inspect damage, write estimates, or decide how a job should be done. We do not charge you for the referral. Contractors in our network pay us for the calls we route to them, and that payment does not change what you pay the contractor.

Independent Contractors

Every contractor we connect you with is an independent business. No contractor is an employee, agent, partner or representative of Emergency Water Damage Nyc, and we do not act on behalf of any contractor. Each contractor:

We ask contractors in our network to be licensed and insured, but we do not verify every credential on every job, and credentials can lapse. It is your responsibility to confirm that a contractor holds the licensing, permits and insurance required for your work before you let it start. Good questions to ask include: Can I see proof of your license and liability insurance? Will you pull any required permits? Do your technicians follow IICRC drying standards? Will I get a written scope of work before you begin?

No Warranty of Work, Availability or Response Time

We do not warrant or guarantee any work performed by any contractor. We also do not promise that a contractor will be available when you call, that one will accept your job, that it will arrive within any particular time, or that its work will meet your expectations. Arrival times, if any, are set and confirmed by the contractor. Sometimes no contractor is available in your area, and we may be unable to connect your call.

Any warranty on workmanship or materials comes only from the contractor or the manufacturer, under their own terms. Ask the contractor about its workmanship warranty before work starts.

Estimates, Pricing and Payment

Any estimate, quote, price or payment term is strictly between you and the contractor. We do not set prices, review estimates or approve invoices. Before you authorize work, ask the contractor for a written estimate and scope of work, and make sure you understand what is included.

All payments for work go directly to the contractor. We never collect payment for repairs or restoration. If anyone claims to be collecting payment on behalf of Emergency Water Damage Nyc for a job, do not pay and call us. Questions about billing, deposits, refunds or insurance claims should go to the contractor and, where relevant, your insurance company.

Emergencies and Safety

Our line is not an emergency service. If anyone is in immediate danger, call 911 first. That includes situations such as:

Do not enter flooded areas where the power may still be on. If it is safe, shut off the water supply at the main valve. Follow instructions from emergency responders and your utilities before you follow any general information on this site.

Call Recording and Telephone Consent

Calls to and from Emergency Water Damage Nyc may be recorded and monitored for quality assurance, training, call tracking, billing and fraud prevention. By calling, you consent to that recording. The contractor your call is routed to may also record calls under its own policies.

By calling our number, you ask us to connect your call to an independent contractor and you consent to that connection. You also consent to receive follow-up calls and text messages about your request, from us or from the contractor your call was routed to, at the number you called from, including calls placed with automated technology, consistent with the Telephone Consumer Protection Act (TCPA). Message and data rates may apply. Your consent is not a condition of any purchase. You can opt out at any time by telling the caller you do not want more calls or by replying STOP to a text. To stop contact from a contractor, tell the contractor directly. We honor do-not-call requests. Our Privacy Policy explains these practices in more detail.

Acceptable Use

You agree to use the website and phone line only for real requests and lawful purposes. You agree not to:

We may block numbers, refuse service or report misuse to the authorities when we believe these rules have been broken.

Website Content Is General Information

Articles, tips and explanations on this site, such as descriptions of water categories, drying equipment or insurance steps, are general information only. They are not professional, engineering, legal, insurance, health or financial advice, and they may not fit your situation. Every property and every loss is different. Rely on the contractor you hire, your insurance company and other qualified professionals for advice about your specific situation.

Intellectual Property

The website, including its text, design, graphics, logos and layout, belongs to Emergency Water Damage Nyc or its licensors and is protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, modify, distribute, republish or create derivative works from the site without our written permission. Contractor names and trademarks belong to their owners.

Disclaimer of Warranties

The website, the phone line and the referral service are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be error-free or uninterrupted, that information on it is complete or current, or that any contractor will meet your needs. Some places do not allow certain warranty disclaimers, so parts of this section may not apply to you.

Limitation of Liability

To the fullest extent the law allows, Emergency Water Damage Nyc and its owners, employees and vendors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of property, data, profits or use, arising out of or related to the service, the website, or any work, advice, delay, omission or conduct of any contractor. This includes damage to your property, mold growth, delayed drying, personal injury and disputes over price or quality of work.

Because the referral service is free to you, if we are found liable to you for any reason, our total liability will be limited to the smallest amount the law allows. Nothing in these Terms limits liability that cannot be limited by law, such as liability for our own fraud.

Indemnification

You agree to defend, indemnify and hold harmless Emergency Water Damage Nyc and its owners, employees and vendors from any claims, losses, damages and costs (including reasonable attorney fees) arising from your misuse of the website or phone line, your breach of these Terms, false information you provide, or your dealings with any contractor.

Disputes and Governing Law

Disputes about the quality, price or timing of work are between you and the contractor, and should be raised with that contractor first. Your insurance company, local consumer protection office or licensing board may also be able to help.

If you have a dispute with Emergency Water Damage Nyc about the referral service itself, please call us first. Most problems can be solved with a conversation, and we will try in good faith to resolve it within 30 days. If we cannot, either side may bring a claim in small claims court, or in a court with proper jurisdiction where Emergency Water Damage Nyc is organized. These Terms are governed by the laws of the state where Emergency Water Damage Nyc is organized, without regard to conflict of law rules, and by applicable federal law. You and we each agree to bring claims only on an individual basis and not as part of a class action, to the extent the law allows.

Changes to These Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Changes apply from that date forward and do not affect calls made before the change. If you keep using the website or calling the line after an update, you accept the updated Terms.

Severability and Entire Agreement

If any part of these Terms is found unenforceable, that part will be limited or removed only as much as needed, and the rest of the Terms will stay in effect. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later. These Terms and our Privacy Policy are the entire agreement between you and Emergency Water Damage Nyc about the website and the referral service. Your agreements with any contractor are separate.

Contact Us

We handle questions about these Terms by phone. Call us any time at Call +1-877-637-9008. The line is open 24 hours a day, 7 days a week.
